As the US Supreme Court yesterday heard argument on whether Section 230 shields Facebook and other platforms from liability if users commit violence in response to posted material, our current study of social media and the law fits well into relevant current events. Today, Nina discussed the case against Napster ,the music sharing platform, alleging copyright infringement under a theory of vicarious infringement. We discussed the distinction between Napster's liability for the infringement of its users and Facebook and Google's liability for the criminal actions of its users in response to posted material. Nina offered insightful analysis and I noted how many of the members of the Court during yesterday's argument shared many of the concerns Nina voiced regarding the government's ability to meaningfully require social platforms to monitor and regulate social media posts.
